Terms of Service

These Terms govern your use of the TriviaSpot smartphone app (the "App") provided by 中村海道 ("we"). By using the App you agree to these Terms.

1. The service

1. The App notifies you of, and shows, trivia about a place — for example when you have stayed there for a while.
2. Trivia text is written automatically by artificial intelligence (AI).
3. The App is intended for people aged 18 and over (see section 10).
4. In countries and regions that the provider of the AI that writes the trivia (Anthropic) does not support, we do not create or deliver trivia, even while you are travelling, as that provider's terms require. This is decided by the two-letter country or region code. Anthropic excludes some regions of Ukraine, which the code cannot tell apart from the rest of the country, so we do not create or deliver trivia anywhere in Ukraine.

2. AI-generated content

1. Trivia is written by AI from the place names alone, using the AI's own knowledge. It is not checked by us or anyone else before it reaches you. We do not guarantee that it is accurate, complete or up to date, and it may contain mistakes.
2. Trivia may include legends, folklore or rumours, that is, stories that may not be true. We instruct the AI to word such stories as such ("is said to", "legend has it", "rumour has it"), but this depends on the AI's judgement, so something uncertain may still be written as if it were a fact.
3. Do not rely on trivia for decisions about safety, health, law or money, or as a reason to enter a place or take an action.
4. Because of location inaccuracy, you may occasionally receive trivia about a nearby place other than where you are.
5. If you find a mistake or inappropriate content, please use "Report a mistake" in the App. Content reported by several users is hidden automatically.

3. Using the App safely

1. Do not look at or operate the App while walking, or while driving a car, riding a bicycle or operating any other vehicle.
2. Even if a place is mentioned in trivia, do not enter restricted or private areas, and follow local laws, rules and etiquette.
3. We are responsible for accidents related to your use of the App only to the extent set out in section 9.

4. Prices and subscriptions

1. The basic features are free.
2. "Premium" is offered as an auto-renewing subscription through the App Store or Google Play. The plans on sale (for example, the monthly plan, which renews every month), with their price and period, are shown on the purchase screen (tax included where applicable).
3. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Cancel in your store's subscription settings; deleting the App does not cancel it.
4. Refunds follow the rules of the respective store. Except where required by law, we do not refund payments.

5. Prohibited conduct

You must not:

1. Violate any law or public order
2. Put excessive load on our servers, make automated mass requests, or circumvent usage limits
3. Reverse engineer the App or server for abuse, or exploit vulnerabilities
4. Submit false or mass reports or otherwise disrupt the service
5. Sell or provide trivia from the App to others while guaranteeing it as fact
6. Do anything else we reasonably consider inappropriate

6. Intellectual property

1. Copyright and other rights in the App belong to us or the rightful owners.
2. You may enjoy trivia for personal purposes and share it with the App's share feature.

7. Changes, interruptions and end of service

1. The App is run by one individual. We may change features, interrupt the service temporarily, or end it.
2. If we end the service, we will normally announce it in the App at least 30 days in advance and stop selling subscriptions so that no new charges occur after the end date.
3. The service may be interrupted without notice due to failures of external services (AI, hosting, stores), natural disasters or other unavoidable events.

8. Updates

We provide updates to improve the App and to comply with laws. Only when unavoidable, such as for legal compliance, may we stop old versions from working and ask you to update.

9. Disclaimer and limitation of liability

1. We do not guarantee that the App fits your particular purpose, is always available, or is free of defects.
2. Except in cases of our intent or gross negligence, our liability for damages arising from your use of the App is limited to the greater of the amount you paid for the App in the 12 months before the month in which the damage occurred and 1,000 Japanese yen.
3. The previous paragraph does not apply where the law (including consumer protection law) does not allow such limitation.

10. Age requirement

1. The App is intended for people aged 18 and over. People under 18 may not use the App (including subscriptions).
2. If someone under 18 has been using the App, they should stop using it. Data on the phone can be deleted with "Delete all data on this phone" in the App's Settings. Cancellations and refunds of subscriptions follow the store's procedures, as set out in section 4. Parents and guardians can contact us at the address below.

11. Changes to these Terms

We may change these Terms when necessary. We will announce the effective date and the changes in advance in the App or on this page. For important changes, we will ask for your agreement again.

12. Transfer

If we transfer the business of the App to a third party, we may transfer our position, rights and obligations under these Terms, and your information (within the scope of the Privacy Policy), to the transferee, and you agree to this in advance. We will announce such a transfer in the App or on this page.

13. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Mito District Court has exclusive jurisdiction as the court of first instance, without prejudice to the right of a consumer to bring an action in the court of their place of residence where mandatory law provides so.
